§1 Definitions
For the purposes of these terms and conditions, the following terms are defined as:
- Customer - A person with full legal capacity who has entered into or intends to enter into an Agreement with the Seller, not directly related to their business or professional activities, or a natural person who is at least 13 years old. If the person is under 18 years old, consent from their legal representative is required. This also includes legal persons and organizational units not being legal persons, which are granted legal capacity by specific provisions.
- Store - The online store and service available at https://ekspertzdrowia.com/, through which the Customer can purchase products and services available in the Store.
- Seller - mgr farm. Maria Karpowicz Ekspert Zdrowia, ul. Asfaltowa 5 m 2 02-527 Warszawa 02-527, NIP 5213400111
- Product - All products and services available in the store, subject to the price indicated during their presentation in the Store.
- Regulations - These regulations.
- Order Form - The space in the Service that initiates the order processing process. Placing an order is not equivalent to concluding an Agreement.
- Agreement - The order for a Service placed by the Customer by completing the Order Form along with accepting these Regulations and paying in full for the Product using the payment methods available in the Service.
§2 Preliminary Provisions
- Through the Store, the Seller conducts retail sales and provides electronic services to the Customer. Through the Store, the Customer can purchase products displayed on the Store's pages.
- The Regulations define the rules and conditions for using the Store, as well as the rights and obligations of the Seller and the Customer.
- Using the Store, including making purchases, does not require the Customer's computer or other device to meet any special technical conditions.
It is sufficient to have a device with a standard operating system, internet access, and a standard web browser (latest version or two versions back); an active email account; cookies enabled; and JavaScript enabled. - The Seller is not responsible for difficulties in using the service resulting from incorrect software or hardware configuration by the Customer, or from problems with the Customer's hardware or internet connection.
- It is prohibited to provide illegal content when using the Store, especially through forms available in the Store.
- All product prices listed on the Store's pages are gross prices.
§3 Services Provided Electronically
- Through the Store, the Seller provides electronic services to the Customer.
- The main electronic service provided to the Customer by the Seller is the ability to place an order in the Store. Placing an order is done by completing and submitting the order form through the Store's automated mechanism.
- Placing an order is done without creating an Account in the Store.
- Services provided electronically to the Customer are free of charge. However, sales Agreements concluded through the Service are chargeable.
§4 Placing an Order
To place an order, the Customer must take the following steps:
- Select the product(s) to be ordered by clicking the "Add to cart" button.
- Proceed to the cart view.
- Complete the order form, providing the necessary information for order fulfillment.
- Read and accept the Regulations. The Customer accepts the Regulations only if they have read and agree with its provisions; acceptance of the Regulations is voluntary but necessary to place an order.
- Click the "Buy and pay" button.
- After clicking the "Buy and pay" button, the Customer will be redirected to the Przelewy24.pl transaction page to make the payment. After making the payment, the Customer will be redirected back to the Store's confirmation page. At this point, the sales agreement for the products covered by the order is considered concluded between the Customer and the Seller.
- After clicking the finalizing order button, the Customer will be redirected to the payment gateway according to their chosen payment method. The Sales Agreement will be concluded at the moment the Store's system confirms the successful payment.
- Payment confirmation will be sent to the Customer's email address provided in the order form.
- The Customer declares that all data provided in the order form is true. The Seller is not obligated to verify their accuracy but has the right to do so.
- To ensure the security of the Customer and data transmission when using the Store, the Seller takes technical and organizational measures appropriate to the level of threat to the security of services provided, especially measures to prevent unauthorized access and modification of personal data.
- The Seller takes actions to ensure the correct functioning of the Store.
- Any complaints related to the functioning of the Store can be reported by the Customer via email to kontakt@ekspertzdrowia.com . The complaint should include the Customer's name, correspondence address, type, and date of the malfunction. The Seller will review all complaints within 14 days of receipt and inform the Customer of its resolution via the email address used for the complaint. The response will be sent to the contact provided during the order.
- The Seller reserves the right to extend the period specified in point 12 by no more than 10 days if the complaint requires unusual, special actions and arrangements, or encounters obstacles beyond the Seller's control (hardware, internet network failures, etc.).
§5 Payment Methods
- The only available payment method in the Store is online payment via Przelewy24.pl. The payment card operator is PayPro SA, Agent Rozliczeniowy, ul. Kanclerska 15, 60-327 Poznań, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Poznań Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register under number KRS 0000347935, NIP 7792369887, REGON 301345068.
- Detailed rules for using the payment methods provided by Przelewy24.pl are specified in the corresponding regulations provided by this supplier. Using these payment methods implies acceptance of the provisions of these regulations. The Seller is not responsible for the payment process conducted by Przelewy24.pl.
§6 Personal Data and Cookies
- The principles of personal data processing and the use of cookies are described in the privacy and cookies policy.
§7 Final Provisions
- The Seller reserves the right to introduce and cancel offers, promotions, and to change product prices in the Store without prejudice to the rights acquired by the Customer, especially the conditions of agreements concluded before the change.
- The Seller reserves the right to change the Regulations. Agreements concluded before the change in the Regulations are governed by the Regulations in effect on the date of the agreement.
- These Regulations are effective from 20.07.2024.
Consultation Regulations
I General Provisions
- These regulations specify the terms and conditions for using the services offered on the website www.ekspertzdrowia.com. www.ekspertzdrowia.com
- The service provider is mgr farm. Maria Karpowicz Ekspert Zdrowia, ul. Asfaltowa 5 m 2 02-527 Warszawa 02-527, NIP 5213400111
- The service recipient (hereinafter referred to as the Patient) is a user who has registered an account in the System.
- The Patient is identified in the System using their provided email address. The Patient may, but is not required to, provide additional identifying information.
- The service provider offers a pharmaceutical consultation service (hereinafter referred to as the Consultation) and other pharmaceutical services (conducted by a master pharmacist and a phytotherapist) regarding the safety of medication use. The detailed scope of services is defined in Chapter II.
- Within a registered System account, the Patient can schedule multiple Consultations, each new Consultation being a separate service.
II Scope of Services
- A Consultation involves providing the Patient with information about the safety of using one or more medications, their interactions, side effects, and correct usage after collecting a medical history and obtaining necessary health information from the Patient.
- Other pharmaceutical services (as described in the Act on the Profession of Pharmacist of December 10, 2020, Art. 4) may also be provided during the Consultation:
- Conducting a pharmaceutical interview,
- Providing pharmaceutical advice to ensure the correct use of a medicinal product, medical device, or special dietary food,
- Conducting medication reviews along with evaluating pharmacotherapy to identify and resolve medication-related issues and ensure safety in the pharmacotherapy process, procesie farmakoterapii,
- Developing an individual care plan considering the Patient's medication-related problems to set achievable therapeutic goals and ways to resolve identified issues, emphasizing health education, health promotion, a healthy lifestyle, and health prevention,
- Collecting data and reporting adverse effects to the appropriate authorities.
- The provided services constitute a documented process where the pharmacist, in collaboration with the Patient, oversees the proper course of pharmacotherapy.
- Consultations are provided electronically, by phone, or in person.
- Information provided by the pharmacist is based on the current state of medical knowledge, pharmacology, pharmacokinetics, and human physiology. However, due to the complexity and specificity of the human body and individual patient predispositions, unreported side effects may occur during the use of medications, dietary supplements, and special dietary foods.
- The provided services do not replace consultations with a doctor and appropriate diagnostic tests. Before using any medication, consult a doctor to clarify all potential risks and benefits.
III Consultation Process
- Scheduling a Consultation requires logging into the System with a previously registered and verified email account.
- After logging into the System, the Patient can add new requests and view the history of all their Consultations. The list of all consultations is visible in the "My Consultations" tab.
- During the Consultation, both the pharmacist and the Patient can add comments in the Consultation view. The Patient receives an email notification about the added comment.
- In case of service cancellation, the Patient does not incur any costs from the provided estimate, and the Consultation is marked as "Cancelled".
- Payment for the consultation is made via a link to a fast payment system. The Consultation service and other services provided by the Service Provider through the System are exempt from VAT under the Act of March 11, 2004, on goods and services tax, Chapter 2, Art. 43, pt. 19c (Dz.U.2023.1570).
- The Service Provider reserves the right to reject a submitted Consultation. The Patient is informed via email, and the rejection justification is available in the Consultation view. In this case, the service agreement is not concluded.
IV Technical Requirements
- To use the Consultation, a device (computer, phone, tablet, etc.) equipped with a web browser and internet access is required.
- Registration in the System requires an email address, which is verified during the registration process.
V Complaints
- To submit a complaint related to the Service, contact the Service Provider via email at kontakt@ekspertzdrowia.com
- The complaint should include the User's email address, name, surname, correspondence address, and the content of the complaint specifying the date of the Service.
- The submitted complaint will be reviewed promptly, within no more than 30 days from the date of receipt.
- The response to the complaint will be sent to the correspondence address provided in the complaint submission.
VI Withdrawal from the Agreement
- According to Article 27 of the Act of May 30, 2014, on consumer rights, a User who has concluded a remote agreement or outside the business premises has the right to withdraw from the agreement within 14 days without giving a reason and incurring costs, except for the costs specified in Art. 33, Art. 34 para. 2, Art. 35 of the Act.
- To exercise the right of withdrawal, the User must inform the Service Provider of their decision before the service is performed, within 14 days of accepting the consultation cost.
- After the service is performed according to the cost accepted by the User, the User is not entitled to withdraw from the agreement, in accordance with Art. 38 para. 1 of the Act of May 30, 2014, on consumer rights.
VII Privacy and Personal Data

At any time, the Patient has the right to access, correct, delete, or object to the processing of their data. For any matters related to personal data , contact via email at kontakt@ekspertzdrowia.com.
- Personal data is processed based on the Patient's consent to fulfill the agreement between the parties.
- To provide the service, the Patient provides their email address and may, but is not required to, provide their name and surname. Data is used to provide the service (Consultation), contact the Patient, and send educational materials according to the regulations.
- To process payments via the fast payment operator, we transfer the Patient's email address to PayPro S.A. (Przelewy24.pl) for payment services.
- In specific situations, providing health information regarding the Patient may be required. This data is confidential and used solely for the Consultation, not disclosed to third parties.
- Data entrusted by the Patient is stored securely, preventing third-party access, including data transmission. The Patient is obliged not to disclose their access password to their account in the System.
